WHAT IS A NOTARY PUBLIC

There are many misconceptions of what a notary public is. Simply, a notary public serves an an impartial witness with the authority to verify signer's identity, the power to witness the signing of documents, administer oaths and authenticate documents. Which the entire encounter with the notary public is when the notary performs the notarization of the the document.

The potential for fraud and identity theft puts most people's assets (cash, property, family, identity)  at risk. Most companies and individuals rely heavily on documentation before taking action on an request or transaction on your behalf. Therefore they need to make certain it was you, the named person on the document, who actually signed the document and NOT an impostor. It is essential that the notary verifies the signer of the document.

The significance of the notary public is not solely to certify documents, but ultimately is to protect the signer's assets by stopping acts of forgery fraud by an impostor's attempt to benefit with unauthorized access your assets. .

Once the Notary Public verifies a signer with a picture ID and witnesses their signature, only then , will the notary proceed to authenticate the very document that was asked to be notarized.

Although notary public are indirectly associated with the legal field, it does not  necessarily mean that Notaries are  attorneys.  

So you may find that most notaries may proceed to notarize your legal document, however, they may refuse , and should, refrain from giving legal advice outside the scope of notarizing the document. Questions, such as "will this document , after it is notarized,  stand in court?" is a legal question that should be asked directly to an attorney, not a notary who doesn't hold a license to practice law. 

The distinction between the notary public and the attorney is that the notary verifies the signer of documents and the attorney is certified to practice law.
